e-Alert – DOL Releases New Model Employer CHIP Notice

Summary

As of January 31, 2020, The Department of Labor (DOL) has revised and released updated information for the new model Employer Children’s Health Insurance Program(CHIP) Notice. The updated model asks employers to provide their employees with information on eligibility for premium assistance under Medicaid or CHIP.

CHIP is a government-sponsored program that offers low-cost health care coverage for children whose families are unable to afford premiums under an employer-sponsored group health plan, but do not qualify for Medicaid.

As a reminder, the CHIP Reauthorization Act of 2009 requires all employers with group health plans covering members in states that provide premium assistance subsidies through Medicaid or CHIP to notify their employees annually of the opportunity to receive these premium assistance subsidies.

Since the model notice lists all the states that offer premium assistance, the DOL allows employers to meet their obligation simply by providing the notice to all employees, regardless of where they live.

The DOL model notice is generally updated periodically to reflect changes in the states that offer premium assistance subsidies, including the contact information for those states. For more information, the revised DOL model notice can be found here.
