D.C. Joins “Ban the Box” Movement

Washington D.C. has joined the “Ban the Box” movement with the signing of – The Fair Criminal Record Screening Act of 2014 – which prevents employers with more than 10 employees working in District of Columbia (D.C.) from asking job candidates about their criminal history on initial job applications. However, this new law expands beyond traditional “ban the box” laws and also places restrictions on an employer’s ability to “withdraw a conditional offer and take adverse action against an applicant by requiring the employer to determine a legitimate business reason for such decisions along with providing specific reasons for the adverse decision”.
